Current psilocybin laws and regulations in Nevada
Psilocybin is not decriminalized in Nevada and possession of under 14 grams is a Category E felony. Nevada has, however, gone further than most prohibition states on the policy side: SB 242 (2023), sponsored by Sen. Rochelle Nguyen, created a 15-member Psychedelic Medicines Working Group under the Department of Health and Human Services, citing the FDA's breakthrough-therapy designation for psilocybin in treatment-resistant depression. That working group's report recommended a state-regulated therapeutic access framework and reduced penalties. The follow-up pilot bill, AB 378 (2025), died. Because Nevada's legislature meets biennially and there is no 2026 session, the earliest vehicle for acting on those recommendations is 2027.
